{"id":3554,"date":"2016-07-10T08:29:08","date_gmt":"2016-07-10T06:29:08","guid":{"rendered":"http:\/\/www.dafyomi4women.org\/daf\/?p=3554"},"modified":"2016-07-10T08:29:08","modified_gmt":"2016-07-10T06:29:08","slug":"bava-kamma-40","status":"publish","type":"post","link":"https:\/\/www.dafyomi4women.org\/daf\/2016\/07\/bava-kamma-40\/","title":{"rendered":"Bava Kamma 40"},"content":{"rendered":"<p><a href=\"http:\/\/www.dafyomi4women.org\/daf\/wp-content\/uploads\/2016\/07\/Study-Guide-Bava-Kamma-40.pdf\">Study Guide Bava Kamma 40<\/a><\/p>\n<p>An animal owned by one who is deaf, not mentally capable or a minor &#8211; they are not responsible for the animal. \u00a0However a guardian is appointed to be in charge. \u00a0Exactly what he pays and whose money he pays from and in which case (<em>tam<\/em> or <em>muad<\/em>) is debated. \u00a0A braita is quoted which says that a guardian is not responsible for paying the ransom fee that one pays if the ox kills a person. \u00a0a discussion ensues about what is the nature of the ransom payment and can it be derived from a tannaitic debate &#8211; is it repentance or compensation for the family of the deceased? \u00a0Some other questions are raised by Rabbi Acha bar Yaakov and he stumps Rav Nachman on them regarding the nature of the repentance of this ransom payment. \u00a0Can it be shared by joint owners and if so, how?
